can greencard applicant waiting for i485 quit job or start own business?
Published by admin on March 9, 2010I submitted my I485 more than 1 year ago, still waiting. Want to start my own business, can I quit my job and start working on that (get things set-up, try to get funding etc.)?

If you’re working, you must be here on a working visa of some sort. To obtain that visa, however, you must have a sponsorship from an American-based company.
If you go into business for yourself, you change your status and (probably) void the working visa conditions. If this were to occur, you’re most likely to get your I-485 petition thrown out (regardless of where it is in the approval process). You’re also likely to be asked to leave the country … you no longer have a valid visa, and are therefore an ‘illegal alien’.
You could try to do all the preliminary leg-work (set up funding, etc) for your prospective business while still working at your existing job … but the bank, etc may ask for papers proving you are eligible for the money (i.e. a citizen) – without them, you’d be out of luck.
